Shopping malls to be fined Rs. 10,000 if charging extra money for carry bags

GUWAHATI: Consumers can slap shopping malls and other retailers with a penalty of Rs 10,000 to Rs 15,000 if shopkeepers ask for extra money for carry bags, said an expert.

Big shopping malls in the city are still charging additional money from customers for carry bags, starting from Rs 5 to Rs 20 for each bag.

Manjit Kumar Das, advocate, Guwahati High Court and Consumer Court, was quoted by News18 as saying, “Since March 2018, it was made illegal for shopkeepers or shopping malls to charge extra money from consumers for plastic bags or paper bags or any kind of bags. Case can be filed before the Consumer Redressal Forum just by submitting an application. The Forum will issue a notice on the basis of that application.”

 

In order to file a case at the Consumer Court, which is situated in every district, the complainant has to submit an application along with the bill of his/her purchase.   

The consumer can even ask for compensation for the metal torture they have to bear from the shopkeepers and these complaints can be filed online as well.

A resident of Guwahati recently became the victim of such an incident where he was charged for a carry bag at a ‘Khadim's’ showroom in Guwahati. The person argued with the staff of the showroom about the wrongfully charged money, but was unable to successfully present his case in this regard. 

The person then visited the Consumer Court in Chandmari area of the city along with the bill to file a complaint against the showroom.

    Every want to just claim money by going to consumer court for ads on Carry bags. Did any this even it's our duty to save environment by reducing the usage of bags. Even to make paper bags we need to cut tree. And tree will not grow in one day. As per the record in has LEES tree. And we want to use Paper bag. Instead of blaming other why can't we make a habit of keeping a bag in our vehicle. And the people who complaint. About all this things are those who plan and go for shopping with family the person who go alone for shopping never argue with this. Because they don't have time. So please start blaming other and start being responsible for environment.

    Agreed plastic bags are bad for environment, and should be banned. But these days the malls and shops give paper bags and environmental friendly bags with their shop names and ads and still charge you for the bags !!! This is common in Big bazaar, spar , lifestyle , shoppers stop and all the branded outlets ... most of the time it’s an emergency shopping or sometime it’s a impulsive shopping and you don’t expect a customer to carry his own bag !!! So it’s unfair to charge the customer who gives you business !!

    Hi, Is there any rule or GO or Section saying that Plastic Carry Bags to be given Free of Cost to the Consumer. IF YOU PROVIDE CARRY BAGS WITHOUT ANY CHARGE, WHAT IS THE INTENT OF THE ENVIRONMENTAL LAWS. GOVT HAS TO BAN COMPLETE PLASTIC USAGE AT MANUFACTURING LEVEL. AS A REGISTERED BRAND OWNER, RETAILERS CAN ENTITLED TO PRINT THEIR LOGO/ MARK. THERE IS NO LAW PROHIBIT CONSUMER BRING THEIR OWN CARRY BAG.

    No malla are following the rules. I went to Fbb,paltan bazar they too were charging for carry bags. when i told them that they cannot charge extra for shopping bags one of the cashier said that they are not following the rule. I think the consumer court should be made more accessible by providing contact numbers so that the victims can easily contact them .

    Few days back I asked the cash counter person of Sohum Shopee Christian basti about charging the bag to which he said they are waiting for Honb'l Supreme Court's order and are not bothered about any other order passed by the Honb'l High Courts of any State.

    Unfortunately, no shopping malls in guwahati are following this rule. A few days back, representative sitting in cash counter of brand factory argued saying that it only applies to Bata since there is no order in general for others & only Bata India has lost a case with a consumer. So, it only applies to Bata & not other malls. Even, same situation happened in Max shopping mall where they said they had no such instructions from their management. Infact, everybody is running their own show in their own way. They don't care any laws until they are exposed in camera & penalized
